Welcome to Fair Recovery Pty Ltd. These Terms and Conditions outline the legal agreements between you, our valued client, and us, Fair Recovery Pty Ltd, as you engage our services.
Our mutual understanding is paramount for a successful partnership, and we are committed to providing you with exceptional service while ensuring clarity and transparency in our processes.
1. Definitions
Advocacy Services: Our professional efforts to support and pursue your claim for a refund.
Applicable Products: Insurance policies or loans that may have been mis-sold to you, potentially qualifying for a refund.
Claim: The formal authorization you provide us, allowing us to seek a refund on your behalf.
Client Portal: Our digital platform designed for secure submission of documents and essential information.
Document Review Services: Our initial evaluation to determine the feasibility of your claim.
Fee: A payment equal to 33% of the refund amount, charged upon the successful resolution of your claim.
Provider: Financial institutions, including banks and insurance companies, against whom your claim is directed.
Refund: The monetary amount reimbursed to you by a provider as a result of a successful claim.
2. Process Overview
Account Setup: Your acceptance of our agreement is confirmed upon registration on the Client Portal.
Information Submission: You are required to provide all necessary details through the Client Portal for the evaluation of your claim.
Review and Assessment: We conduct a thorough assessment of your claim's potential based on the information you provide.
Advocacy Execution: If the claim is deemed viable, we proceed to advocate on your behalf with the provider.
Refund and Fee: A successful claim leads to a refund, from which our fee is deducted.
3. Our Services
Document Review: We analyze your information to decide whether your claim can proceed. This service is provided at no charge if we determine the claim is unlikely to succeed.
Advocacy: Following a positive initial review, we will represent your claim to the provider, aiming for a successful refund. We will accept fair offers on your behalf and contest unfair decisions, referring the case to the Australian Financial Complaints Authority (AFCA) at no additional cost to you.
Consent to Proceed: We will seek your explicit consent before accepting any compensation offers that would result in the termination of a live insurance policy. For all other cases where the offer is deemed fair, we will proceed with acceptance.
4. Your Commitment
Provide Accurate Information: It is crucial that the information you provide relating to your Applicable Products is both complete and truthful. Please ensure to promptly inform us of any changes in your information or circumstances that might affect your Claim.
Exclusive Representation: By engaging our services, you agree to work exclusively with us for the pursuit of the Claim in question. Should you engage another company for the same Claim, whether before, during, or after our engagement, we reserve the right to charge a fee of up to $99. This fee compensates for the resources expended in the assessment of a Claim that cannot be successfully pursued due to dual representation.
Refund Processing: Upon successfully securing a Refund for you, our team will make every reasonable endeavor to contact you, up to eight times via the email and phone number you provided. These attempts aim to arrange the transfer of your Refund. If we cannot reach you after these attempts, we will make additional attempts to contact you, each incurring a charge of up to $20 to cover our outreach efforts. If these subsequent attempts also do not yield a response within a reasonable timeframe, we reserve the right to retain the funds. At this juncture, the responsibility to claim any Refund rests with you, and we encourage you to contact us to facilitate your claim.
5. Fees and Payments
No Win, No Fee: Our commitment to you is simple; if we do not secure a Refund, you owe us nothing. Fee Structure: Should a Refund be obtained, you agree to a fee of 33% of the Refund amount, which compensates us for the services rendered.
Cancellation Policy: You may cancel your agreement within 30 days of acceptance without incurring any fees. Beyond this cooling-off period, a cancellation fee may apply depending on how much progress we have made with your claim. This fee is calculated as either $99 or 33% of the estimated potential Refund, whichever is greater, to cover the work we have already performed on your behalf.
6. Communications
Client Portal: Our Client Portal serves as the primary channel for communication, updates, and information exchange regarding your Claim.
Data Security: We take significant precautions to protect your information. However, please be aware that no method of transmission over the Internet, or method of electronic storage, is 100% secure.
Written Confirmations: To ensure clarity and maintain accurate records, we may, from time to time, request written confirmation of verbal instructions you provide.
7. Privacy and Confidentiality
Data Protection: We handle your personal information with the utmost care, adhering strictly to privacy laws and our comprehensive Privacy Policy.
Confidentiality: Your information is kept confidential within our firm, disclosed only with your consent or as legally required.
8. Dispute Resolution
Feedback: Your feedback is invaluable to us, and we are committed to addressing any concerns or complaints swiftly, in line with our internal complaint resolution procedures.
Disputes: Should disputes arise under this Agreement, we encourage you to communicate these to us in writing. Our goal is to resolve any issues amicably and efficiently, ensuring your satisfaction with our services.
9. General Terms
Governing Law: The laws of New South Wales, Australia, govern this Agreement, ensuring that both parties have a clear legal framework within which to operate.
Entire Agreement: This document constitutes the entire agreement between you and Fair Recovery Pty Ltd, superseding any prior agreements or discussions.
Amendments: Any modifications to this Agreement must be made in writing and mutually agreed upon by both parties to ensure transparency and mutual understanding.
